Disclaimer
of Warranties:
The limited warranty stated on your invoice is the only warranty
applicable to your product. All other warranties, including the
implied warranties of merchantability and fitness for a particular
purpose, are hereby disclaimed. All warranties are limited in duration
to the limited warranty period and to replacement or repair of the
defective part(s). No warranties apply after that period.
Limitation
of Liability:
Any liability of C&D Services under this agreement is expressly
limited to the price you have paid for a product. Your sole remedy
against C&D Services and its employees in any dispute under
this agreement shall be to seek recovery of the amount you have
paid for the product. Upon the payment of which C&D Services
shall be released from and discharged of all further obligations
and liability to you. In no event shall either party be liable to
the other for special, exemplary, consequential, incidental or indirect
damages, including, but not limited to, loss of anticipated profits
or revenue, economic loss, loss of data, loss of the use of the
product or any associated equipment, loss of capital, cost of substitute
or replacement equipment, facilities or services, down time, your
time, the claims of third parties, and injury to property, regardless
of the nature of the claim. |
